Contest Terms and Conditions
NaramataBlooms Contest – Official Rules – May 19 - June 30, 2023
NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THE FOLLOWING CONTEST RULES (THE “CONTEST RULES”).
1. PROMOTION DESCRIPTION
All Contest competitions begin on the specified start date, as per the web page or social media post, and end on the specified end date, as per the web page or social media post.
By participating in the Contest, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Discover Naramata (DN), which shall be final and binding in all respects. DN is responsible for the collection, submission or processing of Entries and the overall administration of the Contest. Entrants should look solely to DN or with any questions, comments or problems related to the Contest. DN may be reached by email at hello@discovernaramata.com during the Promotion Period.
2. ELIGIBILITY
Open to legal residents of British Columbia and Alberta who are at least 19 years of age. DN, and their respective parents, subsidiaries, affiliates, members, board members, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees, are ineligible to enter the Contest or win a prize. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Contest is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law.
Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof within a reasonable period of time may result in disqualification. All personal and other information requested by and supplied to Sponsors for the purpose of this Contest must be truthful, complete, accurate and in no way misleading. Sponsors reserve the right to disqualify any entry or entrant in its sole discretion, should any entry or entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
3. PROMOTION PERIOD
The contest begins at 4:00 p.m. Pacific Standard Time (“PST”) on May 19, 2023, and closes at 11:59 p.m. PST on June 30, 2023 (the “Promotion Period”).
4. HOW TO ENTER
There is no purchase necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning. To enter, complete and submit the entry form at www.discovernaramata.com/win (the “Contest Website”). No other entries will be accepted by any other means.
a. Limit of one (1) Entry per person. Entries received shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry. For the purpose of these Contest Rules, the “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be required to provide Sponsors with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning Entry.
b. Multiple Entries by the same person using one or more e-mail accounts shall result in disqualification. All Entries must be received no later than the end of the Promotion Period. Entries will be declared invalid if they are late, irregular, garbled, or mechanically or electronically reproduced.
5. PRIZE
a. There will be four (4) prizes awarded to 4 separate contest winners (“Winners”):
PRIZE #1 (approx. value $310)
1 night in a glam tent from Chute Lake Lodge, $50 gift card to The Restaurant at Poplar Grove Winery, and a hyper-local goodie bag of treats and gifts from from Farm to Glass Wine Tours
PRIZE #2 (approx. value $180)
Student pass to a future painting workshop from Art of Marina, Naramata-grown lavender soap, cream and dried lavender from Playlist Orchards, wine tasting experience and gift card to Three Sisters Winery
PRIZE #3 (approx. value $180)
Tours and experiences at JoieFarm Winery, Tightrope Winery, Nichol Vineyard
PRIZE #4 (approx. value $100)
90 minute SUP Rental for 2 from Sun ‘N Sup and $50 gift certificate to Legend Distilling
The businesses contributing the prizes are responsible for letting the winner know any additional details of their contributed prize.
The prizes have their approximate value listed. The winner is not entitled to monetary difference between actual prize value and stated prize value, if any. The winner will be provided with contact details and instructions for redeeming, and will be responsible for coordination of their prize experience bookings. Reservations are required for most prize elements. Any and all portion(s) of the prize package cannot be refunded for cash or exchanged or transferred or used during any other dates.
c. Winner must comply with all Contest Rules.
d. All prizes must be accepted as awarded and cannot be transferred, assigned, substituted, or redeemed for cash. Sponsors reserve the right, in their sole discretion, to substitute a prize of equal or greater value if the described prize cannot be awarded for any reason.
e. The businesses donating tours/tastings of wineries are responsible to verifying age of winner and guests.
6. WINNER SELECTION & NOTIFICATION
The Potential Winner of the Contest will be selected in a random drawing throughout the Promotion Period on Monday July 3, 2023. Odds of winning will vary depending on the number of eligible Entries received.
The selected Potential Winners will be notified by phone or email (via the email address provided in the Entry Information), no later than Tuesday July 4, 2023 and must respond within two (2) business days of notification. Upon notification, the selected potential Winner must respond by email or telephone to the contact information provided in the notification, within two (2) business days of such notification. If the selected potential Winner does not respond in accordance with these Contest Rules, he/she/they will be disqualified and will not receive a prize and another potential Winner will be selected. Sponsors are not responsible for the failure for any reason whatsoever of a selected potential Winner to receive notification or for Sponsors to receive a selected potential Winner’s response.
Any Potential Winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively \”the Prize Claim Documents\”). No substitution or transfer of a prize is permitted except by Sponsors.
7. CONDUCT
By entering this Contest, entrant agrees to be bound by these Contest Rules, which will be posted at the Contest Website throughout the Promotion Period. Entrant further agrees to be bound by the decisions of the Sponsors, which shall be final and binding in all respects. Sponsors reserve the right, in their sole discretion, to disqualify any entrant found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest, the Contest Website; and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN 5 ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION
8. PRIVACY
Any personal information supplied by you will be subject to the privacy policy of DN posted at www.discovernaramata.com/privacy-policy. By entering the contest, you agree that if chosen as a winner, the winners of the contest will be announced on social media by first name, last initial, and city of residence. By entering the Contest, you grant DN permission to share your first name, last name, and email address with the other Contest Entities for the purpose of administration, prize fulfillment and DN marketing emails. After receiving an initial email, you may opt out any time from DN marketing emails, if so desired.
9. LIMITATION OF LIABILITY
Sponsors assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Contest or download of any materials in the Contest.
If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part. In such event, Sponsors shall immediately suspend all drawings and prize awards, and Sponsors reserve the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsors. Sponsors and Released Parties shall not have any further liability to any participant in connection with the Contest.
10. INTELLECTUAL PROPERTY
All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by Discover Naramata, Farm to Glass Wine Tours, Three Sisters Winery, Chute Lake Lodge, Tightrope Winery, Art of Marina, JoieFarm Winery, Poplar Grove Winery, Nichol Vineyard, Sun ‘n Sup, Playlist Orchards, Legend Distilling, Naramata General Store, Naramata Inn, and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
11. LAW
These are official Contest Rules. This Contest is subject to applicable federal, provincial and municipal laws and regulations. These Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial or municipal laws or the policy of any other entity having jurisdiction over the Sponsors.
